--Credit Card/Bank Account Agreement--
By registering and paying for Melómano Inc. Dance classes, events, services, or products I hereby authorize Melómano Inc., LLC to charge my credit card or bank account in advance for all applicable fees incurred by me in connection with my chosen service and registration. I further understand and agree that it is my responsibility to notify Melómano Inc., LLC of any changes to my credit card or bank account or if my credit card has expired otherwise my access to the Service may be discontinued or interrupted. All fees shall be paid in U.S. dollars.

--Intellectual Property Rights--
All class choreography and materials is the sole property of Melómano Inc. and may not be used for personal purposes outside of class unless written permission has been received from Patrick Hernandez and Melómano Inc.

The trademarks and trade dress of Melómano Inc. are proprietary to Melómano Inc. and may not be used by you for any reasons other than as expressly permitted by these terms. All Website and App content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, Melómano Inc.. You have the right to view, electronically copy, and print in hard copy portions of the Website and App for the sole purpose of making class reservations, purchases, or other personal use.

Any other use of materials on the Website, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of Melómano Inc. is strictly prohibited.

You acknowledge that Melómano Inc. and/or third party content providers remain the owners of all Website and App materials, and that you do not acquire any of those ownership rights by downloading, copying, or using any such material in accordance with these Terms. Melómano Inc. may discontinue or remove the Website or App, or any portion thereof, or discontinue your right to use the Website or App, or any portion thereof, at any time.


--Release of Liability--
By signing up for and/or attending classes, events, activities, and other programs and using the premises of Melómano Inc. you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in dance in association with the Classes and use of the Dance studio. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You also acknowledge that the specific risks vary from one activity to another.

If in the subjective opinion of the Melómano Inc. staff, you would be at physical risk using Melómano Inc.'s Classes and Dance Studio, you understand and agree that you may be denied access to the Classes and Dance Studio until you furnish Melómano Inc. with an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing Melómano Inc.s concerns and stating that Melómano Inc.s concerns are unfounded.

In consideration of being allowed to participate in and access the Classes and Dance Studio, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Classes, whether sustained while dancing or not, (2) release, indemnify, and hold harmless Melómano Inc., its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Classes or use of the Dance Studio, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of Melómano Inc.s Classes and Dance Studio, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in using Melómano Inc.s Classes and Dance Studio, and should not be participating in any Classes.



--Photography Release--
I, the Student, grant unrestricted rights to Melómano Inc., for the publishing of photographs or recordings of the Student for commercial, promotion, competition, or other purposes.


--Acceptance of Terms--
By using the Website or App, purchasing a Melómano Inc class, registering for a Melómano Inc. class, booking a class, purchasing merchandise, and/or using or attending a Melómano Inc. class, you signify your acceptance of the Terms. If you do not agree to this, please refrain from using the Website or App, purchasing a Melómano Inc. class, registering for a Melómano Inc. class, booking a class, purchasing merchandise, and/or using or attending a Melómano Inc. class.

Occasional changes may be made to this document to reflect changes in Melómano Inc.s policies. The Terms may be revised at any time by updating this posting. By using the Website or App, by buying Melómano Inc. classes, registering for classes, booking classes, buying merchandise, and/or using and attending Melómano Inc.s studios, you agree to be bound by any such revisions. Dancers and community members are encouraged to check this document periodically to stay informed of current guidelines.


--ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19:
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies have put in place recommended social distancing, occupancy restrictions and guidelines for businesses to follow. Melómano Inc. has put in place preventative measures to reduce the spread of COVID-19; Melómano Inc. has implemented all recommendations from California state officials as per Melómano Inc.'s Studio Safety & Social Distancing Guidelines document available on our website.

Melómano Inc. will make every effort to keep our studio sanitized and to prevent symptomatic employees and dancers from entering the building. However, COVID-19 has been proven to be asymptomatic in some persons. Therefore, Melómano Inc. cannot guarantee that you or your child(ren) will not become infected with COVID-19 or any other unknown virus. Further, attending Melómano Inc. could increase your risk and your child(ren)s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Melómano Inc. and that such exposure or infection may result in personal injury, illness, permanent disability, and death. By signing this agreement, I agree that my child and any accompanying persons will not enter Melómano Inc. if we exhibit any of the following new or worsening signs or symptoms of possible COVID-19: A temperature greater than 100.4 degrees Fahrenheit, cough, shortness of breath or difficulty breathing, other respiratory symptoms, or at least two of the following symptoms: chills, repeated shaking with chills, muscle pain, sore throat or new loss of taste or smell. I also agree that, neither my child(ren) nor any accompanying adult will enter Melómano Inc. if we have had known close contact with a person who is lab-confirmed to have COVID-19.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)s attendance at Melómano Inc. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Melómano Inc., its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Melómano Inc., its employees, agents, and representatives, whether a COVID-19 or other currently unknown virus infection occurs before, during, or after participation in any Melómano Inc. dance program or class. In the event of a shelter in place, classes will convert to virtual classes and instruction will continue.
